This document describes the right of withdrawal available to consumers in the European Union who order a personalized gift video story from Animora. The service produces a digital video file — no physical medium is involved.

Legal basis: Directive 2011/83/EU of the European Parliament and of the Council on consumer rights and the mandatory national law implementing it in the consumer’s country of habitual residence.

1. Your right to withdraw

You have the right to withdraw from your contract with Animora within 14 days without giving any reason.

The withdrawal period expires 14 days from the day the contract is concluded — that is, from the day you place your order and make the first payment (Art. 9 of Directive 2011/83/EU).

If you were not informed of your right of withdrawal before the contract was concluded, the period is extended by 12 months (Art. 10 of Directive 2011/83/EU).

Please note that production of your film begins immediately after your first payment — while the 14-day withdrawal period is still running. What happens if you withdraw during production is explained in Sections 4 and 5 below.

2. How to withdraw

To exercise your right of withdrawal, simply inform us of your decision by an unambiguous statement.

The simplest way is by email to email@animora.video, with the subject line “Withdrawal from contract” and your order number.

Your statement can take any written form, as long as it clearly states your decision to withdraw. Using the withdrawal form template (Section 6) is not mandatory — it is offered only as a convenience.

To meet the withdrawal deadline, it is enough to send your withdrawal notice before the 14-day period expires.

3. Effects of withdrawal

If you withdraw from the contract, we will refund all payments received from you, less — where applicable — the amount owed to us under Section 5 below for services already performed up to the point of withdrawal.

We will make the refund without undue delay, and in any event no later than 14 days from the day on which we are informed of your decision to withdraw (Art. 13 of Directive 2011/83/EU).

The refund will be made using the same payment method you used for the original transaction, unless you expressly agree to a different method. You will not incur any additional fees as a result of the refund.

4. When the right of withdrawal is lost

The right of withdrawal does not apply once we have fully performed the service — that is, once we have delivered your finished, completed film — provided that:

• we began performing the service at your explicit request, made before the withdrawal period expired, and
• you were informed in advance that you would lose your right of withdrawal once the service was fully performed, and you acknowledged this.

In the Animora ordering process, both of these conditions are satisfied through two separate, explicit statements that you accept before payment:

“I request that production of my video begin before the 14-day withdrawal period expires, and I expressly and explicitly give my prior consent to this.”

“I acknowledge that once the service has been fully performed and the finished video delivered to me, I will lose my right of withdrawal.”

In other words: for as long as your film is not finished and delivered, your right of withdrawal remains fully available to you (subject to the proportionate payment described in Section 5). Once the finished film is delivered, the service is fully performed and the right of withdrawal is extinguished.

5. Proportionate payment if you withdraw during production

If you requested that performance begin before the withdrawal period expired (which is the standard case — see Section 1) and you withdraw from the contract before the service has been fully performed, you are required to pay for the services already performed up to the time you informed us of your withdrawal (Art. 14(3) of Directive 2011/83/EU and the corresponding national provision).

We calculate this amount proportionately to the work already completed relative to the full scope of the contract, according to the production-stage scale below:

The scale is cumulative: the percentage shown is the total amount owed for all work completed up to the end of that stage. The percentages are not added together.

Any remaining amount you paid (above what is owed for the last completed stage) is refunded in accordance with Section 3.

The same scale appears in §10 of the Terms of Service — both must be changed together.
